These Terms of Service (“Terms”) govern your access to and use of the website, software products, and services provided by Vladimir Gutesa Preduzetnik BIM-IT (“BIM-IT”, “we”, “us”, or “our”).

By accessing our website or purchasing and using our software products, you agree to be bound by these Terms.

2. Products and Services

BIM-IT develops and sells digital software products, including but not limited to Revit add-ins and related tools (“Software”).

The Software may be offered as:

• subscription-based products (monthly or annual), and/or
• trial versions for evaluation prior to purchase.

3. Payments and Merchant of Record

All purchases are processed by Paddle.com, which acts as the Merchant of Record.

Paddle is responsible for:

• payment processing
• invoicing and tax handling (including VAT)
• refunds and chargeback management

By completing a purchase, you agree to Paddle’s checkout terms in addition to these Terms.

4. Software License

Use of the Software is governed by our End User License Agreement (EULA), which forms an integral part of these Terms.

5. Trial Versions

Some Software products are offered with a time-limited trial period to allow evaluation prior to purchase.

Trial versions may be limited in duration or functionality. Availability of a trial does not eliminate or replace applicable refund rights described below.

6. Subscriptions

Some Software products are offered on a subscription basis, either monthly or annually.

Subscriptions:

• begin on the date of purchase,
• automatically renew at the end of each billing period unless cancelled prior to renewal.

Annual subscriptions may be offered at a discounted price compared to monthly subscriptions.

You may cancel your subscription at any time through Paddle. Upon cancellation, access to the Software will remain active until the end of the current billing period.

7. Refund Policy

Refund requests may be submitted within 14 days of the initial purchase, provided that:

• the request is made through Paddle, and
• the Software has not been activated or used beyond reasonable evaluation purposes.

By purchasing the Software, you acknowledge that a trial version may have been available prior to purchase.

For subscription purchases, refunds apply only to the initial billing period and do not apply to subsequent renewals.

All refunds are handled exclusively by Paddle and are subject to their review and approval.

8. Acceptable Use

You agree not to:

• misuse the Software,
• attempt to reverse engineer, decompile, or bypass licensing or activation mechanisms,
• use the Software in violation of applicable laws or regulations.

Violation of these terms may result in suspension or termination of your license.

9. Disclaimer of Warranties

The Software is provided “as is” and “as available”, without warranties of any kind, express or implied.

We do not warrant that the Software will be error-free, uninterrupted, or suitable for any specific purpose.

10. Limitation of Liability

To the maximum extent permitted by law, BIM-IT shall not be liable for:

• indirect, incidental, or consequential damages,
• loss of profits, data, or business opportunities,
• damages arising from the use or inability to use the Software.

Our total liability shall not exceed the amount paid for the Software during the applicable billing period.

12. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the Republic of Serbia, without regard to conflict of law principles.
